By accessing or using CouchLoop ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

CouchLoop is a HIPAA-compliant therapy practice management platform designed for licensed mental health professionals and their clients. These Terms apply to all users of the Service, including therapists, clients, and administrators.

2. Description of Service

CouchLoop provides a comprehensive platform for therapy practice management, including but not limited to:

  • Client and session management
  • Secure messaging and communication
  • Homework assignment and tracking
  • Clinical note generation and storage
  • Practice analytics and reporting
  • AI-powered clinical support tools

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice to you.

3. User Accounts and Eligibility

Therapist Accounts: To create a therapist account, you must be a licensed mental health professional with appropriate credentials to practice in your jurisdiction. You represent and warrant that all information provided during registration is accurate and current.

Client Accounts: Client accounts are created through invitation by licensed therapists using the platform. By accepting an invitation, you acknowledge that you are entering into a therapeutic relationship with the inviting therapist.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Privacy and Data Protection

Your privacy is critically important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

HIPAA Compliance: CouchLoop is designed to be HIPAA-compliant. We implement appropriate administrative, physical, and technical safeguards to protect Protected Health Information (PHI). Therapists using the platform must execute a Business Associate Agreement (BAA) with us.

Data Ownership: You retain all rights to the content you create and store on the platform. We do not claim ownership of your clinical notes, client information, or other data.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any local, state, national, or international law
  • Infringe upon or misappropriate the intellectual property rights of others
  • Transmit any malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for any purpose other than professional mental health services
  • Share your account credentials with unauthorized individuals

6. AI-Powered Features

CouchLoop includes AI-powered features designed to assist mental health professionals. These features are tools to support clinical judgment, not replace it.

Professional Responsibility: Licensed therapists remain solely responsible for all clinical decisions and judgments. AI-generated content should be reviewed and verified by the treating professional before being used in clinical practice.

No Medical Advice: The AI features do not provide medical or therapeutic advice and should not be relied upon as a substitute for professional clinical judgment.

7. Payment and Subscriptions

Access to certain features of the Service requires a paid subscription. By subscribing, you agree to pay all applicable fees as described in your chosen plan.

Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method for all applicable fees.

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features through the end of your current billing period.

Refunds: Subscription fees are non-refundable except as required by law or as expressly stated in these Terms.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COUCHLOOP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately.

Upon termination, you may request an export of your data within 30 days. After this period, we may delete your account and associated data in accordance with our data retention policies and applicable law.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
